What is a Judicial Review?

When a public body has acted unlawfully, judicial review is the main remedy to hold them to account and determine that their decisions have been made fairly and only using the powers that they have for their proper purposes.

Judicial Review applications are made to the High Court to challenge an unlawful, unreasonable and irrational decision of a public body.  The Judicial Review claim must be made as soon as possible and certainly within 3 months of the decision under challenge. 

Public bodies must not breach laws make to protect an individual’s fundamental rights and interests, such as the Human Rights and Data Protection Acts 1998, the Equality Act 2010 and EU law. These laws exist to ensure that individuals are treated with dignity, basic freedoms are not abused, personal information is not misused and that characteristics that are central to an individual’s identity, such as race, gender, sexuality, faith, and disability, are respected and do not lead to unfair treatment.
