Equality and Discrimination

Equality Act 2010 & Discrimination Law

The Equality Act 2010 exists as no one should experience unfair treatment on grounds of race, gender, sexual orientation, religion or disability. The Equality Act 2010 makes discrimination on these grounds unlawful,  Our Eqaulity and Discrimination Law Solicitors are here to make sure you are treated fairly.

With our Human Rights Law, Public Law and Judicial Review background, we have the knowledge and experience to deal with your case, as fighting injustice and discrimination is at the heart of what we do.

Under the European Convention on Human Rights 1950, brought into English law by the Human Rights Act 1998, you are guaranteed your most fundamental human rights. This includes the right to life, the right to freedom of expression and the right to liberty.

The right to freedom from discrimination is contained in Article 14 of the ECHR. This means that it is illegal to discriminate on any grounds, including sex, race, language, religion, political beliefs, gender, sexual orientation and disability. If you have experienced discrimination because of any of these personal attributes, you may be able to make discrimination claim under the Human Rights Act 1998 and the Equality Act 2010.

Discrimation can occur in various different scenerios and settings and by private and public bodies.  You maybe discriminated by your employer or as a result of a decision taken by a public body such as local authorities, NHS, Home Office, Police, Department for Work and Pensions.

Claims for equality and discrimination can be brought under various pieces of law and court can make a decalartion that the deicsion maker acted unlawfully, require the decision to be put right and can offer compensation.

If a public body has discriminated in the provision of public services, we can use the law to help challenge this discrimination in the courts. In some case we can bring Judicial Review challenges and force a public body to reconsider a discriminatory decision. We can also bring civil claims which can lead to a declaration of a breach of your human rights and,in some circumstances, can lead to an award of compensation. These cases have wider significance because they can prevent other individuals from suffering the same discrimination in the future.
